End-User License Agreement (EULA) for Luge
Introduction
This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Luge for the Luge application software, which includes computer software and may include associated media, printed materials, and online or electronic documentation ("App").
By installing, copying, or otherwise using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the App.
1. Acknowledgement
You acknowledge that this EULA is concluded between you and Luge, and not with any third-party app store provider. Luge, not the app store provider, is solely responsible for the App and its content.
2. Scope of License
This EULA grants you a non-transferable license to use the App on devices that you own or control and as permitted by the terms and conditions of the app store from which you downloaded the App.
3. Maintenance and Support
Luge is solely responsible for providing any maintenance and support services for the App, as specified in this EULA or as required under applicable law.
4. Warranty
Luge provides the App "as is" and with all faults. No warranty is given that the App will be error-free or uninterrupted, or that any defects will be corrected.
5. Product Claims
Luge, not the app store provider, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.
6. Intellectual Property Rights
You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Luge, not the app store provider, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country.
8. Termination
This EULA is effective until terminated by you or Luge. Your rights under this EULA will terminate automatically without notice from Luge if you fail to comply with any term(s) of this EULA.
9. Governing Law
This EULA shall be governed by the laws of the United States of America excluding its conflicts of law rules.
10. Changes to This Agreement
We reserve the right to update or change this End-User License Agreement at any time. Any changes will be posted on this page with an updated revision date. Your continued use of the App after any such changes constitutes acceptance of the new terms.
